Shipping & Returns
Shipping timeframes, carriers, tracking, damage/loss liability, returns and Australian Consumer Law rights.
Shipping is not free
Every order attracts a shipping fee calculated at checkout based on parcel weight, destination and the carrier / service level you select. We do not offer complimentary or blanket free shipping on any order. Any “free shipping” reward earned inside the Mine Game or via specific admin bundles is an exception, is clearly labelled at the moment of redemption, and is capped to standard domestic Australia Post satchel rates.
Domestic (Australia)
- Australia Post Signature-on-Delivery is our default carrier for orders under A$5,000.
- Orders over A$5,000 ship fully insured via Registered / Platinum service. Insurance is included in the shipping fee shown at checkout.
- Dispatch within 2 business days of cleared payment. VIP priority-dispatch orders ship the same business day where placed before 11 am AEST.
- Tracking is emailed automatically the moment the parcel is scanned in.
International
International orders ship via Australia Post International Express(default) or a private courier of your choice at cost. Delivery windows vary from 5–30 business days depending on destination and customs. We can only guarantee that the parcel leaves our door.
International Duties and Taxes
Shipping charges shown at checkout cover postage and handling only, except for orders sent to the United States and its territories (US, Puerto Rico, Guam, American Samoa, Northern Mariana Islands, US Virgin Islands, US Minor Outlying Islands).
United States & US territories. Applicable U.S. import duties are calculated and prepaid by us as required by U.S. Customs (CBP) and Australia Post. These costs may be included in the shipping charge or displayed separately at checkout.
All other international destinations. Customers are responsible for any customs duties, import taxes, VAT or processing fees charged by their destination country. These charges are not included in our product or shipping prices and may be payable before delivery.
Orders that are refused or abandoned due to unpaid customs charges may incur return shipping costs and administration fees. Original shipping charges (and any prepaid U.S. duty) are non-refundable. Any refund issued for a returned international order will exclude shipping costs and any customs-related fees incurred.
Loss, damage & liability — please read
3 Mile Design PTY LTD (ABN 16 694 438 812) is not responsible for any loss, theft, delay, mis-delivery, damage or destructionof goods once they have been handed to the carrier. Title, risk and responsibility for the parcel transfer to you (the buyer) at the moment the parcel is scanned in for dispatch. That includes:
- Loss or theft in transit or upon delivery.
- Damage, scratches, chips or fractures caused during handling.
- Deliveries left at a mailbox, unattended door, or with a neighbour.
- Rejected parcels held at customs and subsequently destroyed.
- Delays due to weather, industrial action, pandemic, or carrier failure.
Where you have paid for insurance at checkout, we will assist you in lodging a claim with the carrier — but the claim itself is between you and the carrier. Our maximum liability for any shipping-related dispute is limited to the shipping fee you paid, and nothing more. To the fullest extent permitted by Australian law, we exclude all other liability for shipping loss, damage or delay, whether direct, indirect, consequential or otherwise. This clause does not limit the guarantees you have under the Australian Consumer Law that cannot be excluded, restricted or modified by contract.
Returns
Because opals are natural, high-value gemstones cut by hand, all sales are final. We do not offer change-of-mind returns, exchanges or refunds — see our No-Refund Policy below for the full detail and the mandatory Australian Consumer Law guarantees which we cannot exclude (major fault, misdescription, unfit for purpose).
Missing parcel — what to do
- Check with your local post office (parcels are sometimes held).
- Ask neighbours and check safe-drop spots at your property.
- Contact the carrier directly with your tracking number.
- If still missing after 10 business days (domestic) or 45 days (international), email hello@3miledesign.com — we will help you lodge the carrier claim.
Privacy Policy
How 3 Mile Design collects, stores, uses and shares your personal information under the Australian Privacy Act 1988.
What we collect
When you create an account, place an order, contact us or interact with our services we collect: name, email, phone, billing and shipping address, payment metadata (we never store full card numbers — Stripe handles that), date of birth (where required for age-restricted purchases), and technical data such as IP address and browser user-agent. VIP members may additionally complete Stripe Identity KYC.
How we use it
- To process orders, payments, payouts and shipping
- To run our Trade Room, auctions, messaging and notifications
- To prevent fraud and comply with Australian AML/CTF requirements
- To measure ad performance via Meta Pixel / Conversions API
- To communicate transactional emails and (where you have opted in) marketing
How it's stored and shared
Data is encrypted in transit and at rest, hosted in Australia and the US via our cloud providers. We share data only with: Stripe (payments & identity), Resend (transactional email), Cloudflare R2 (media storage), LiveKit (live video) and Meta (Pixel/CAPI events you have not opted out of). We never sell your personal data.
Your rights
Under the Privacy Act 1988 (Cth) and the Australian Privacy Principles you can request access, correction or deletion of your personal information at any time. Email hello@3miledesign.com. We respond within 30 days. If unsatisfied you can complain to the Office of the Australian Information Commissioner (OAIC).
Retention
Account data is retained while your account is open and for 7 years after closure to comply with Australian tax and consumer-law record-keeping obligations. Marketing preferences are honoured immediately.
Terms of Service
The contract between you and 3 Mile Design for using our website, marketplace, Trade Room and live auctions.
Who we are
3 Mile Design (ABN 16 694 438 812) is an Australian opal and gemstone retailer and online marketplace based in the Northern Territory. “We” / “us” means 3 Mile Design; “you” means the person accessing the site or buying from us.
Eligibility & accounts
You must be 18+ and able to enter a binding contract under Australian law. Keep your login confidential and notify us immediately of unauthorised access. We may suspend or terminate accounts that breach these terms, are used fraudulently, or fail verification. Trade Room sellers may require additional KYC under AML/CTF rules.
Orders, pricing & GST
All prices are in AUD inclusive of GST where applicable. We may correct pricing errors before dispatch and refuse any order priced in error. A contract is formed when we send the order-confirmation email.
Payments
Payments are processed by Stripe Inc. and Stripe Australia Pty Ltd. We do not store full card numbers. By paying through our checkout you also accept Stripe's end-user terms.
Intellectual property
All photos, videos, descriptions, AI-generated copy, the 3 Mile Design logo and brand assets are owned by us or licensed to us. You may not reproduce, scrape or redistribute the content without prior written permission. Fair-dealing rights under Australian copyright law are preserved.
User content
When you post a listing, photo, video, comment, review or message you grant us a non-exclusive, royalty-free, worldwide licence to host, display and promote that content on our site and reasonable marketing channels. You confirm you own or have rights to what you post.
Prohibited behaviour
- Counterfeit, mis-described or misrepresented goods
- Attempting to circumvent payments, auctions or KYC
- Scraping the site or extracting bulk data without consent
- Impersonating another person or business
- Shill-bidding, wash-trading or auction manipulation
Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure, and compensation for any other reasonably foreseeable loss or damage. Nothing in these terms is intended to exclude, restrict or modify your ACL rights.
Limitation of liability
To the extent permitted by law, our total liability for any claim arising out of your use of the site is limited to the amount you paid us in the 6 months before the claim arose. We are not liable for indirect, incidental or consequential loss. Nothing in this clause limits ACL rights.
Governing law
These terms are governed by the laws of the Northern Territory of Australia. You submit to the non-exclusive jurisdiction of the NT courts (with appeals to the relevant federal courts).
Changes
We may update these terms; the “Last updated” date at the top reflects the most recent change. Material changes will be emailed to account-holders. Continued use after a change means you accept the update.
No-Refund Policy
All sales are final. The only exception is the Australian Consumer Law guarantees, which we cannot exclude.

3 Mile Design does not offer returns, refunds, exchanges or partial refunds on any product — whether purchased via Buy Now, Make an Offer or won at a live auction.
Every piece is unique. By placing an order or a bid you confirm that you have reviewed the photos, video and description, asked any questions you need to ask, and are committed to the purchase. We encourage you to message the seller before bidding or buying if you have any questions.
Australian Consumer Law (ACL)
Nothing on this page excludes the consumer guarantees provided under the Australian Consumer Law. You are entitled to:
- a replacement or refund for a major failure;
- compensation for any other reasonably foreseeable loss or damage; and
- repair or replacement where the goods fail to be of acceptable quality and the failure does not amount to a major failure.
A “major failure” includes goods that are significantly different from the listing photos, video or description, are unsafe, or are unfit for their normal purpose.
How to make an ACL claim
Email hello@3miledesign.com within 7 days of delivery with your order number, a clear description of the issue and photos showing the alleged defect or mis-description. We acknowledge every claim within 1 business day. Outside of valid ACL claims, no refunds will be issued.
How approved ACL refunds are paid
Where a refund is required under the ACL it is issued to the original payment method via Stripe and typically appears on your statement within 5–10 business days. We do not issue refunds in cash, by direct deposit or to a different card.
Auction Terms
Live auctions are binding. Pre-live countdown, 5-minute anti-snipe, 24-hour payment window and shill-bid prohibition.
Every bid is binding
When you place a bid on a 3 Mile Design live auction you are making a binding offer to purchase the lot at that price if you remain the highest bidder when the lot closes. By tapping BID you confirm you understand and accept this.
Minimum bids & increments
Each lot has a starting price set by the seller. Subsequent bids must beat the current high bid by at least the minimum increment shown on screen (typically 5% of the current bid, rounded). You can place a custom higher bid at any time.
Anti-snipe extension
If a bid is placed in the final 5 minutes of the lot, the timer is extended by 5 minutes from that moment. Extension continues for as long as bids keep coming in the final 5 minutes.
Pre-live countdown
When the host taps “Start Lot”, a 10-second countdown plays before bidding opens. Any bid attempted during that countdown is rejected by the system and does not eat into the lot's bidding window.
Winning & payment
- An automatic Stripe Checkout session is sent to your email
- You have 24 hours to complete payment
- Failure to pay within 24 hours means we may offer the lot to the runner-up bidder at their last bid price, automatically and without further notice
- Repeat non-payment will result in suspension and may be reported as a breach of contract
Item descriptions
Sellers are responsible for accuracy — body tone, brightness, origin, treatments and any synthetic / lab-grown materials must be honestly disclosed. If the item received materially differs, the ACL guarantees apply (see the No-Refund Policy section above) and you may open a dispute through your Order page.
No shill or wash bidding
Bidding on your own lot — directly or via a known associate — is strictly prohibited. We monitor bid patterns and reserve the right to void any bid we believe was placed to inflate price. Shill bidding will result in account termination and may be reported to relevant authorities.
Technical issues & host controls
While we use enterprise-grade hosting and WebSocket infrastructure to keep bidding reliable, we cannot guarantee uninterrupted service. If a confirmed platform outage affects a live lot we may extend, void or re-run that lot at our discretion. The host may pass, withdraw or relist a lot in the event of a description error or connectivity problem; any payment already taken on a withdrawn lot is refunded in full.
Trade Room Member Agreement
The rules every VIP member acknowledges at checkout — listings, fees, off-platform prohibition, disputes, suspension.
Who can join
The Trade Room is open to any 3 Mile Design account holder aged 18+. Identity verification (KYC) via Stripe Identity may be required before you can list, sell, or receive payouts. We may decline or revoke access at our discretion — for example if there is a credible report of fraud, misrepresentation or repeated breach of these rules.
Listing your items
When you list an item you confirm that:
- You own the item or have the seller's written authority to list it
- The description is accurate — body tone, brightness, origin, weight, treatments, and any synthetic / lab-grown disclosure must be truthful
- Photos are of the actual item being sold (no stock photos or “representative” images)
- Any enhancement (oiling, doublets, triplets, polymer impregnation) is disclosed clearly
Mis-described or counterfeit items will be delisted and may result in account termination.
Fees & payouts
3 Mile Design takes a commission on each successful sale. The current rate is shown in your Seller Dashboard and is deducted automatically from the Stripe Connect payout. Payouts follow Stripe's standard schedule (typically 2 business days after a successful payment). You are responsible for any taxes, including GST if you are registered.
No off-platform deals
All sales between members must be completed through the 3 Mile Design Trade Room. Attempting to coordinate an off-platform sale to avoid commission, escrow protection or dispute coverage is a serious breach and may result in immediate account termination and forfeiture of pending payouts.
Communications & conduct
Direct messaging, comments and reactions are provided as part of the platform. Harassment, hate speech, doxxing or threats will result in immediate suspension. We may review messages where a dispute has been raised.
Disputes between members
- Contact the other member through in-app messaging within 7 days of the issue
- If unresolved within 14 days, open a dispute ticket from your Order page
- We review the messages, listing description and photos, and make a determination within a further 14 days
- For Buy-Now orders, Stripe Chargeback rules also apply where relevant
Our determinations are made in good faith based on the published evidence. Major Australian Consumer Law guarantees apply regardless of these processes.
Suspension & termination
We may suspend or terminate Trade Room access for material breach of these rules, repeated dispute losses, fraud or any conduct that risks the integrity of the platform. Trade Room access is free for every 3 Mile Design account — the only fee is the seller commission taken on successful sales (disclosed at listing time). Pending payouts clear of dispute are released on Stripe's normal schedule.
